Agreement to Terms
By accessing and using the services provided by Tri State Gutters ("Company," "we," "our," or "us"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
Services Provided
Tri State Gutters provides professional gutter services including but not limited to:
- Gutter installation (5-inch, 6-inch, and 7-inch systems)
- Gutter cleaning and maintenance
- Gutter repair and replacement
- Gutter guard installation
- Underground drainage systems
- Fascia board installation and repair
- Snow guard installation
- Regular maintenance programs
Estimates and Pricing
Free estimates are provided for informational purposes and are valid for 30 days from the date of issue. Final pricing may vary based on site conditions, material costs, and scope changes. All prices are subject to applicable taxes and fees.
Payment Terms
- Payment schedules will be outlined in your service agreement
- We accept cash, check, and major credit cards
- Payment is due upon completion unless other arrangements are made
- Late payments may incur additional fees
- Disputes must be raised within 30 days of service completion
Scheduling and Access
You agree to provide reasonable access to your property for our technicians to perform the agreed-upon services. We will make reasonable efforts to arrive within scheduled time windows, but delays may occur due to weather, traffic, or other unforeseen circumstances.
Customer Responsibilities
- Provide accurate information about your property and service needs
- Ensure safe and clear access to work areas
- Remove or secure vehicles, outdoor furniture, and decorative items from work areas
- Notify us of any hazards, pets, or special considerations
- Be present or designate an authorized representative during service
- Inspect work upon completion and report any concerns immediately
Warranties and Guarantees
Workmanship Warranty
We provide a 2-year warranty on our workmanship for installation services. This warranty covers defects in our installation work but does not cover normal wear and tear, damage from severe weather, or issues arising from customer modifications.
Material Warranties
Material warranties are provided by the manufacturer and vary by product. We will assist with warranty claims but are not responsible for manufacturer defects or warranty limitations.
Limitation of Liability
Our liability is limited to the cost of the services provided. We are not liable for indirect, incidental, or consequential damages. Our maximum liability shall not exceed the total amount paid for services.
Insurance and Safety
Tri State Gutters maintains general liability insurance and workers' compensation coverage. Our technicians are trained in safety procedures and use appropriate safety equipment. You agree to maintain homeowner's insurance coverage during service provision.
Weather and Force Majeure
Services may be delayed or rescheduled due to inclement weather, natural disasters, or other circumstances beyond our control. We will reschedule services as soon as conditions permit and notify you of any delays.
Cancellation Policy
- Services may be canceled up to 24 hours before scheduled appointment without penalty
- Same-day cancellations may incur a service fee
- For installation projects, cancellation terms will be specified in the service agreement
- Materials ordered specifically for your project may incur restocking fees
Property Damage
While we take great care to protect your property, you agree to report any damage immediately after service completion. We will work to resolve legitimate damage claims promptly and fairly through our insurance provider.
Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The prevailing party may recover reasonable attorney fees and costs.
Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the revision date. Your continued use of our services constitutes acceptance of any modifications.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law
These Terms shall be governed by the laws of the state in which services are provided, without regard to conflict of law principles.
